Not a Department of Defense product

Glidepath is commercial software from Glidepath Technologies, LLC. It is not a product of the Department of Defense, the Department of the Air Force, the Air National Guard, or any other U.S. government organization. It is not endorsed, certified, or approved by any of them.

No Authority to Operate

Glidepath does not have a DoD Authority to Operate (ATO), a FedRAMP authorization, or a DoD Cloud Computing SRG impact-level authorization. It is not an authorized DoD information system. Hosting is commercial cloud.

Do not store CUI

You may not enter Controlled Unclassified Information into Glidepath. Under 32 CFR § 2002.4(h), CUI is information the U.S. Government creates or possesses (or that a non-federal entity creates or possesses for or on behalf of the Government) that a law, regulation, or Government-wide policy requires or permits an agency to safeguard or restrict. Both parts must be true, and the type must appear in the National Archives CUI Registry. There is no aggregation rule: putting many unclassified records together does not make them CUI. If information has been designated CUI, or you are not sure, do not put it in this application.

Your chain of command decides, not Glidepath

Using Glidepath at a military unit, installation, or government workplace is solely at your discretion and that of your chain of command. Glidepath Technologies, LLC, its officers, employees, and contractors do not authorize, direct, or approve any unit to use this software. No individual’s military rank, position, or personal affiliation with the company is permission for your location to use it.

1. Agreement

These Terms of Service and this End User License Agreement (together, the “Terms”) are a contract between you and Glidepath Technologies, LLC (“Glidepath,” “we,” “us”) for the Glidepath application, related websites, and associated services (the “Service”).

By creating an account, signing in, or clicking Accept, you agree to these Terms. If you do not agree, do not use the Service.

2. Not a U.S. government product

The Service is commercial software. It is not an official product of the United States Government, the Department of Defense, the Department of the Air Force, the Air National Guard, the Air Force Reserve, or any other federal, state, or local agency.

Nothing in the Service is official DoD policy. Use of military or aviation terminology, forms, or regulatory citations is for operational convenience and does not imply government sponsorship, certification, or approval.

3. No Authority to Operate

The Service does not hold a Department of Defense Authority to Operate, a FedRAMP authorization, or a DoD Cloud Computing Security Requirements Guide impact-level authorization (IL2, IL4, IL5, or otherwise). It is not authorized to operate as a DoD information system on the DoD Information Network.

An Authorization to Operate, if one is ever issued, can be issued only by a government Authorizing Official for a government-sponsored instance. Until that happens, this commercial instance is unofficial IT.

4. Controlled Unclassified Information

You must not store, upload, or process Controlled Unclassified Information (CUI) in the Service.

Legal definition (32 CFR § 2002.4(h)): CUI is information the Government creates or possesses, or that an entity creates or possesses for or on behalf of the Government, that a law, regulation, or Government-wide policy requires or permits an agency to handle using safeguarding or dissemination controls. CUI does not include classified information. It also does not include information a non-executive branch entity possesses and maintains in its own systems that did not come from, or was not created or possessed by or for, an executive branch agency.

Both of the following must be true for information to be CUI: (1) a U.S. Government nexus as described above, and (2) a law, regulation, or Government-wide policy that requires or permits safeguarding or dissemination controls. Categories exist only if they are listed in the National Archives CUI Registry. There is no aggregation or compilation rule that turns uncontrolled unclassified information into CUI merely because many records are stored together.

If a document is marked CUI, or your security office has designated it CUI, do not put it in Glidepath. If you are unsure, keep it out.

5. Discretion of the user and chain of command

Whether you may use the Service for official duties is a decision for you and, where applicable, your chain of command, Authorizing Official, communications squadron, or civilian employer. Glidepath does not make that decision.

Glidepath Technologies, LLC, its officers, employees, contractors, and any person associated with the company in a personal or military capacity do not authorize, direct, or approve use of the Service by any unit, wing, base, airport, or agency. Presence of the software, an account invite, or a demonstration is not command approval.

You are responsible for following your organization’s rules on unofficial software, official records, and information security.

6. Official records

Your organization owns the records it enters. Glidepath stores and serves them; it does not own them.

If you use the Service in a government workplace, treat Glidepath as a working tool unless your organization has designated it as an official records system. Export records into the repository your organization already uses for official files (for example a records-managed shared drive or SharePoint) if that is how your organization keeps the legal copy. Inspectors and records managers should be given those official copies.

The Service is provided as-is. We do not warrant that it will satisfy a particular records schedule, inspection, or form-signature requirement (including any CAC-signature requirement).

7. License

Subject to these Terms, Glidepath grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for airfield or airport operations, solely through the accounts issued to you.

You may not copy, reverse engineer, resell, or provide the Service to third parties except as we agree in writing. We retain all right, title, and interest in the Service.

8. Accounts and acceptable use

Access is limited to users your organization invites. You must keep your credentials confidential and use the Service only for its intended operational purpose.

Do not attempt to access another organization’s records, interfere with the Service, upload malware, or use the Service to store classified information, CUI, or other data your organization forbids in commercial systems.

9. Availability and changes

Unless a signed contract with your organization says otherwise, the Service is provided as-is, without a warranty of uptime, support, or continued availability.

We may update these Terms. Material changes will be presented in the application for acceptance before continued use. The version identifier of the Terms you accepted is stored with your account.

10. Disclaimers and limitation of liability

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Glidepath does not warrant that the Service is error-free or that it is appropriate for any particular government authorization, inspection, or mission.

To the maximum extent permitted by law, Glidepath and its officers, employees, and contractors are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, lost operations, inspection findings, or command action arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount your organization paid us for the Service in the twelve months before the claim, or fifty U.S. dollars if none.
